ASSET PLANNING AND TRUSTS

We act for a number of charitable and not-for-profit organisations. Specifically we provide advice on establishing the optimal structure for not-for-profit and charitable entities. ESTATE ADMINISTRATION
The end of life can be made even more difficult for those left behind if no proper provision for the administration of an estate has been made. This area requires extremely sensitive handling and also a pragmatic and practical approach to ensure that the right things are done in a methodical and timely way. Family dynamics must be well understood and everything possible done to ensure that assets can be realised as quickly as possible and that loved ones do not suffer financial hardship.

We manage the administration of your assets on death. This involves applying to the High Court for the last will to be approved for administration, realising and managing estate assets, paying all outstanding amounts, tax returns for the estate and, when appropriate, distribution of the assets of the estate to the beneficiaries. We also advise estate administrators on any legal issues that may arise during the administration of the estate.

RELATIONSHIP PROPERTY
It is a fact of modern life that relationships may end in separation and divorce. At the beginning of a relationship it is almost impossible to imagine that this might be the outcome, but there can still be a desire to define what will happen to assets held by individually and collectively in the event of a breakdown in the relationship.

Many couples are facing the reality of this situation and are taking the practical step of agreeing what will happen should they separate, and setting this out in a Relationship Property Agreement.

The drafting of such a document requires a skilled approach, combining good rapport with experience in creating a document which achieves the desired outcomes.

WILLS
One way to ensure that your assets will go to those you wish to benefit from your estate is to write a will. Everyone over the age of 18 years should do so.

If you do not have a will, you would die “intestate” and all your assets, including personal possessions would be distributed according to the Administration Act 1969. As a result, your assets could go to people you do not wish to benefit and the costs associated with administering intestate estates are generally higher.
