A restructuring and/or redundancy process can seem a straightforward and plausible option, particularly when market conditions are tough. However, one of the key issues we see employers struggling with is deciding what information to provide as part of a proposal, and how to respond to requests for information from employees. Understanding what information is available to employees, as well as the intersection of employment law and privacy law will help avoid the process dragging out, or derailing.
This workshop will focus on:
- A general overview of the restructure process;
- A refresher on the steps needed for a successful consultation process – including selection criteria and redeployment;
- Complying with the obligations of good faith in a consultation process;
- Understanding the legal obligations regarding the provision of information to employees; and
- Assessing what information you can withhold.
